MOBBER Terms of Service

1. Acceptance of Terms

By creating an account or using MOBBER (the "App") operated by MOBBER LLC ("MOBBER," "we," or "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MOBBER is a social platform that allows users to create and trade Solana SPL tokens ("Meme Coins" or "Meme Tokens"), post content, livestream, and participate in Audio Hives (audio rooms). All tokens are created on the Solana blockchain using open-source bonding-curve and liquidity programs.

3. No Intrinsic Value

Meme Coins created or traded on MOBBER have no intrinsic value and are not securities, commodities, or any regulated financial instrument. They are purely speculative digital assets created for entertainment purposes only.

4. Non-Custodial Wallets

Your wallet is powered by Privy.io and is non-custodial. You alone control your private keys and are solely responsible for their security. MOBBER never has custody of your funds or tokens.

5. Fees

• You are solely responsible for all Solana network transaction fees (gas) required to create tokens, trade, or perform any on-chain action.
• When you trade any token through the MOBBER app, MOBBER charges a platform fee of:
  • 1% on tokens that are still on the bonding curve.
  • 0.5% on any token that is not on the bonding curve (including graduated tokens and tokens trading on external Solana DEXs such as PumpSwap, Orca, Meteora, Raydium, Jupiter, etc.).
• This 0.5% is exclusively MOBBER's platform fee for using our interface and services. Tokens traded on external DEXs may have additional fees charged by those DEXs or by the token creator (e.g., dev buy/sell taxes, transfer fees, liquidity fees). MOBBER has no control over those third-party fees.
• Token Graduation to Raydium: When a token reaches its bonding curve threshold (e.g., 85 SOL raised), liquidity (accumulated SOL + tokens) automatically migrates to a Raydium CMPM (Constant Product Market Maker) pool for open trading. Prior to depositing into the pool, the following costs will be deducted from the accumulated SOL:
  • Raydium Protocol Fee: Approximately 0.15 SOL (to deter spam and support protocol sustainability).
  • Associated Token Account (ATA) Creation: Approximately 0.002 SOL (for liquidity token accounts).
  • Solana Network Gas and Priority Fees: Approximately 0.002–0.005 SOL (depending on congestion).
• These graduation costs total ~0.154–0.16 SOL and are required to utilize Raydium's advanced AMM infrastructure. MOBBER does not keep any portion of these fees—they are entirely paid to Raydium and the Solana network and are non-refundable.
• You are solely responsible for researching and understanding all fees (both MOBBER's and any third-party fees) before trading. Trading meme coins and SPL tokens is extremely risky and you may lose your entire investment.
• All MOBBER platform fees are automatically deducted on-chain and are non-refundable.

6. Eligibility

You must be at least 18 years old to use MOBBER. You represent that you are not barred from using the Service under applicable laws.

7. User Content and Conduct

You retain ownership of content you post (e.g., posts, token images, livestreams, Audio Hives), but grant MOBBER a worldwide, royalty-free license to display, distribute, and moderate it within the Service. We may remove content that breaches these Terms.

We use anonymized AI/machine learning to flag and evaluate content for safety and policy enforcement.

8. Prohibited Conduct

You agree not to post, create, or engage in:

• Content that condones, incites, or encourages violence or terrorist activity.
• Doxxing or sharing private information about others without consent (e.g., addresses, phone numbers).
• Child sexual exploitation or abuse, including any image, video, or description depicting child sexual abuse or exploitation. We report suspected violations to authorities.
• Pornography, sexually explicit content, or nudity (except for artistic/educational purposes, at our discretion).
• Graphic images or videos depicting death, abuse, violence, or self-harm.
• Content promoting illegal activities, scams, or conspiring to commit crimes under laws applicable to your location. We may report violations to law enforcement.
• Harassment, hate speech, or discrimination based on race, ethnicity, gender, etc.
• Manipulating markets (e.g., wash trading, bots), infringing IP, or interfering with the Service (e.g., viruses, reverse-engineering).
• Spam, malicious content, or exploitation of vulnerabilities.

Violating these may result in content removal. Exploiting the Service, App, or functionality is grounds for legal action.

9. Enforcement and Bans

We reserve the right to enforce these Terms at our discretion. Generally, we follow a "3-strikes" policy for minor violations (warnings, temporary restrictions, then ban). Egregious acts (e.g., child exploitation, doxxing, illegal activity) warrant immediate permanent ban without notice. Banned users may not create new accounts.

10. Availability

We cannot guarantee 100% uptime due to third-party services (e.g., Solana, Privy.io) or web interruptions. The Service is provided "as is."

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITH NO WARRANTIES. TRADING MEME COINS INVOLVES EXTREME FINANCIAL RISK AND YOU MAY LOSE YOUR ENTIRE INVESTMENT. CRYPTOCURRENCY PRICES ARE VOLATILE. WE DO NOT ENDORSE OR PROVIDE FINANCIAL ADVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBBER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR CRYPTO ASSETS.

13. Governing Law and Compliance

You are solely responsible for compliance with all laws, rules, and regulations applicable to your use of the Service in the country or region where you reside or access the Service from. We make no representation that the Service is appropriate, lawful, or available for use in all locations.

These Terms and any dispute or claim arising out of or related to them or the Service will be governed by the laws of the country or region in which you reside, without regard to its conflict of law provisions.
